As we know that India .the World’ biggest democracy ,is also well known for its multi culture, multi religions and multi languages diversity . India is like a sub-continental. According to fundamental Rights (Right to religion Art-25 to 28) mention in Indian’s Constitution (The Supreme law of the land) ,every Indians has the right to express their religious culture without hammering any other religions faith. WB Administration Recent Orders on Durga Puja Immersion
Actually, this year (2016) Durga Puja immersion or Bijoya Dashami fell on 11th October. on the same time Muharram occurring the very next day on 12th October. As per source information (collected from media-we have no written order or hand copy in this regard) WB Administration put a order or decided to restrict the Durga Puja Immersion (Bisorjon) in order to facilitate the processions (
Tazia) on the eve of Muharram–
- The biggest Public Puja Pandals were told to immerse their ‘Murtis/ Protimas’ after Muharram
- Durga Puja held in households and those organize by apartments/ housing/ societies , were told to immerse the Murtis before 4.30 P.M
Against the recent government decisions on Durga idols immersion, three petitioners ,representing two households and an apartment complex ,approached to the Kolkata High Court to challenge this government anti religion decision. On 6th October , a single member bench of Justice Dipankar Dutta passed an order which held the the time limit set by the WB Government for Maa Durga Protima immersion as “arbitrary” and said the order was a “clear endeavor” by the state to “appease the minority section of the Public”.
In his Order, Justice Dutta allowed the three petitioners to immerse their Protima by 8.30 P.M on Bijoya Dashami . The Court said on this case that “there has never been a holiday” declared by State or Centre on the Eve of Muhharam to facilitate “Muhhram Tazia“. Justice Dutta also argued that “the administration has failed to take note of the fact that Muhharam is also not the most important festival of people having faith in Islam …” The Judge added “Never has there been a restriction on immersion of Durga Murti on Bijoya Dashami at any earlier point of time .It has been brought to the notice of this bench that in the Year of 1982 & 1983, Muhharam was observed on the day of Bijoya Dashami .But no restriction of the nature impugned herein was imposed” .Justice Dutta claimed the restriction order as “unprecedented” in Bengal history .
